A TPS Immigration Lawyer Who’s Ready To Help

Have you been looking to immigrate to the United States because your country is temporarily dangerous or unstable? If so, we may be able to assist you. TPS (“Temporary Protected Status”) is an immigration status that allows people to immigrate to America when their country is going through a time of instability. Unlike asylum, it tends to help larger groups. A TPS immigration lawyer from our law firm can help in a variety of ways.

How We Help
For starters, we can assist with all of the paperwork and documentation. We understand that, as you or someone you love is dealing with day-to-day struggles in an unstable country, the last thing you want to have to do is to fill out forms, collect paperwork, and the like. We may be able to help. There are multiple forms involved with filing the TPS application, so we strongly advise that you contact an attorney for assistance. Moreover, these applications are specific to the person as it gets as no two TPS applications are the same.

If You’re Filing Late
The “T” in “TPS” stands for “Temporary.” These do have to be renewed. Additionally, some of our clients who have successfully come to America on a TPS actually filed their initial application late as well. This can make the process even more complex. Over the years, we have specialized in helping our clients successfully file for TPS renewal late. The last thing you would ever want is to have to return to an unstable country because you missed a filing deadline. We can work diligently and aggressively to keep that from happening.

If You Want To Travel
Many who come to the United States with TPS want to travel outside of the country occasionally. This is allowed, provided that they have a “travel authorization” for TPS. However, to do this properly and safely, you need to complete Form I-131 (Application for Travel Document) to apply for what’s called “advance parole.” If you don’t do this, your TPS could be lost and it’s entirely possible that when your trip ends you’re unable to come back to America. We don’t want that. Before you travel, reach out to us. We can walk you through your options to ensure the best, most successful outcome.

More Than TPS Immigration Lawyer Services
Really, we can help you to have the best, most successful outcome whether or not you’re applying for a TPS or some other form of immigration. Not all who want to come to America will be eligible for a TPS. If you reach out to us, we can talk to you about your situation and from there, figure out the best way to move forward. For a free consultation, you can reach us at (855) 997-4525.

Ways A Fiance Visa Lawyer Can Expedite And Simplify The Process

Do you want to come to the United States so as to marry your American citizen fiance who’s sponsoring your visa (or vice versa)? Have you been looking for a Fiance Visa lawyer you can trust? If so, then the Rijal Law Firm may be able to help. The K-1 fiance visa makes it possible for you both to live in America. As you might imagine, the process can be complex and challenging. We have helped so many over the years who are in the exact position that you are right now in a multitude of ways.

A Better Way To Handle All Of The Forms

Sponsoring a foreign fiance (or being sponsored) can be stress-inducing, to say the very least. Here at Rijal, we can help you to navigate every part of the process. First, we can help you to prepare and complete all of the forms. We can also help you to collect the proper documentation, too. If you have any questions throughout the process, we’ll be there to answer them quickly and completely.

Prepare You For The Interview Properly

At some point in the process, you will be interviewed by immigration officers. They want to make sure that your relationship is legitimate, and isn’t just some kind of scam designed to get someone into America fraudulently. Now, you may be asked some simple questions (how long have you been together, where did you meet, etc.) Or, you may be asked some more challenging questions. Regardless, we can prepare you so that you’re ready for anything in this interview.

Walk You Through The Entire Process

Everyone’s immigration situation is different. But, if you’re applying for a K-1 visa, the first step is for the American citizen who’s sponsoring their foreign fiance to submit a “Petition for Alien Fiance” (I-129F) to the USCIS field office nearest to where they live. You have to submit it to that particular office – an embassy or an overseas office or something that won’t get the job done. Once that’s been approved by the USCIS, the National Visa Center will process it and send it to a US embassy or consulate. Then, that embassy or consulate will provide the foreign-citizen fiance with a medical examination and more detailed instructions. They will have an interview at the consulate as well.

A Fiance Visa Lawyer Who Can Help

The path can be challenging and difficult at times but it’s always worth it. We can be in a position to make the journey simpler. If you’re considering this visa or any other we can help. At Rijal Law Firm, we can work with you to make the process easier for you and yours. Even if this particular visa isn’t right for you, another one may be. For a free consultation with our immigration experts to see how we can help, you can reach us at (855) 997-4525.

National Interest Waiver Lawyer Explains The Process

Have you been considering immigrating to the United States on the EB-2 National Interest Waiver? Do you have an advanced degree and/or are highly skilled? If so, then this very well may be the right way to immigrate for you. If you tried years ago and found the standards too high, it’s a different day now. Late in 2016, the Supreme Court changed the eligibility threshold, so it’s entirely possible you may qualify now. A National Interest Waiver Lawyer from our firm can help you through the process.

The Waiver Explained

As you may know, with the regular EB-2 visa process, you have to go through a lengthy Labor Certification process (among others). This process can take, at best, six months, but it can also take up to three years. Now, the “National Interest Waiver” essentially is a way to, well, waive that Labor Certification requirement. How? On account of it being in the best interest of America to do it. What can make this particularly attractive is that your petition on your own behalf (or an employer can). You don’t need a job offer requirement, either. Now, the process can still be difficult and challenging. But we can help.

The Test

To receive an NIW visa, there’s a test. You, the foreign national, have to have a “proposed endeavor” that has “substantial merit” and “national importance.” You don’t need to prove that your endeavor will be successful, just that you’re capable of making it successful. On top of that, you have to be seen as well-positioned to be able to advance the endeavor, and it has to be viewed as beneficial to America to waive the labor certification and job offer for you.

The

In that test, USCIS will take into account multiple factors. They can include progress you’ve made already toward achieving the endeavor you’re proposing, your education, your track record, successes you’ve already had, your knowledge and education, the skills you possess, and even your plan will come up. Plus, the USCIS will have to consider how America can benefit from bringing you in to do this even if workers in the United States are available, too. As you might imagine, this entire process can be quite complex indeed.

How A National Interest Waiver Lawyer Can Help

We know that reading the above can seem daunting. However, we can also say that we’ve helped many to navigate the process so that they were able to come to America on an NIW. That said, it might not be the best option for everyone. To that end, we can work with you to find the right immigration solution. For a free consultation with our staff, you can reach us at (855) 997-4525.

How A DACA Immigration Lawyer Can Help

Have you been wondering whether or not you or someone you love is eligible for DACA? Does it seem like there really isn’t much that a DACA immigration lawyer can do for you? The truth is that, just like so much else related to immigration, DACA is complex. Even if you’re eligible, fully versed in the rules, and know your situation, DACA can present challenges. Here at the Rijal Law Firm, we’ve helped so many throughout the years to navigate DACA better, so that people like you can have the outcome they want.

Cutting Through The Scams
Unfortunately, there are so many scams connected to DACA out there. As the stakes are so high, and many willing to do what’s necessary to be able to be in the United States, unscrupulous actors have, unfortunately, tried to take advantage of immigrants. These predatory agencies make frivolous, fraudulent claims: that they can “get you faster approval” or “make the process go quicker,” all for a fee, of course. Don’t fall for it. We can work with you to utilize your status properly so that you can have the best possible outcome.

Taking Care Of You
The paperwork involved with requesting and ultimately filing for deferred action is massive. Moreover, it’s complicated. Any mistake, even a tiny one, can block the entire process. We don’t let that happen. Our experienced attorneys make certain that all of the documents are completed exactly as they should be, and that the paperwork is done right. The last thing anyone wants is a clerical error, a typo, or something so seemingly minor to have a negative impact. Rijal Law Firm has a proven track record of helping folks to get through DACA right.

What A DACA Immigration Lawyer Can Do For You
Really, we can help you at any step of the DACA or immigration process. For example, for years, we’ve renewed applications for already existing DACA recipients, making sure that they’re as strong as they should be. Beyond that, we can also help with taking care of documentation for permits to allow you to travel how and where you’d like outside of America based on DACA as well. Whether you’re requesting DACA for the first time or renewing it, we can help you to get this all done on time and correctly.

Beyond DACA
DACA is one of the better-known forms of immigration, but it’s far from the only way that a person can immigrate. Indeed, often when we’re working with someone seeking to apply for DACA, we find that they may be better served by another process of immigration. We’re always glad to sit down to talk with folks to see how we can best help them to immigrate. For a consultation, you can message us through our site or call (855) 997-4525.

Best Practices For Receiving Approval After NOID

Did you recently receive a NOID or an RFE? Are you unsure what to do next? No one ever wants to get one of these. But, it’s not the end of the world. In fact, it’s not even the end of the NOID process. If you received a NOID, it’s not a rejection or a failing grade. Rather, it’s like receiving an “incomplete.” In fact, by virtue of you receiving a NOID or an RFE, it’s a clear sign that you still have a chance for successful completion. Below are some best practices for receiving approval after NOID.

Something You Can Do Immediately
Make a copy. Make a physical, literal copy of your NOID as soon as you open it. Many even do that before they finish reading it in its entirety. Taking a picture of it on your phone is fine, but be sure to make a copy of it, too. Why? Because with a NOID, you don’t have much time. Usually, you just have 30 days. That’s it. Now, you have to have your NOID at the top of the response package. If you lose your NOID, then the odds of you getting a new NOID in time to put at the top of the response package are low indeed. To make everything easier, make a copy.

Read Thoroughly
It can be frustrating to look at the NOID, particularly if you thought everything would be “smooth sailing,” so to speak. It’s natural to not want to look at it, to put off reading it, etc. As mentioned, the due date is often 30 days from the printed date you’ll find on the NOID. But, it may have a specific due date, unique to your case. Only by reading the document thoroughly can you find this date and thus know. Remember: the USCIS doesn’t go by “postmark date,” they go by “date received.” So, a good rule of thumb: send it seven days before that date.

Get To Work
One thing you will find when you go through your NOID: is what acceptable response documents are. It can be greatly beneficial to look at a copy (should you have one) of the initial package that you sent in. Then, compare the two. It’s entirely possible that the documents they’re asking for were submitted, but they simply didn’t see them, or they’ve been misplaced, and so forth.

Receiving Approval After NOID Process
Once you’ve taken care of all of that, then it may very well be time to reach out to attorneys that can help. We understand how frustrating it can be to have been sent a NOID or RFE, but we can help. Indeed, we’ve helped so many who are in the exact position that you are right now: looking at that NOID and wondering what’s next. For a consultation with our immigration law firm to see how we can help, message us through our site or call (855) 997-4525.

What You Get With A “DACA Immigration Lawyer Near Me”

Have you been typing “DACA immigration lawyer near me” into your phone only to not find anyone that you would actually want to work with? Does it seem like there’s no one around who can help you to understand and move forward with your immigration process? That’s where we can help. Here at the Rijal Law Firm, we’ve helped so many immigrate to the United States, whether they were Dreamers or other people looking for a better life on their terms. We may be able to help you as well.

Who’s Eligible
If you’re applying for DACA for the first time, then you have to have come to America before your 16th birthday. Plus, you need to have been younger than 31 on June 15th, 2012. Additionally, as of that date, you needed to have no illegal status, either. Speaking of specific dates, you need to have resided in the United States continuously since June 15th of 2007. Beyond those date-specific qualifications, you also need to have graduated from high school or be in school now.

How They Can Apply
We’re not going to sugarcoat this: the application process is complicated. It really is. Is it possible to figure it out on your own? Yes. However, that just means that you’ll be able to send it in on your own. That won’t give you the best chance to succeed, to get what you want. With the stakes so high, it makes all the sense in the world to reach out to an experienced attorney who can shepherd you through the process. We can make certain that your DACA request is filed promptly and correctly when you need it to be.

Finding The Right Options
As you may have heard, the Biden administration supports DACA and wants to strengthen and even expand the program. However, as of this writing, DACA doesn’t provide a pathway to citizenship. Someday it may but it doesn’t right now. So, when we talk to people about how to help their immigration, we advocate for a complete legal screening. That way, we can go through all of the available options, just in case there’s one that’s a better fit for you than DACA.

More Than A “DACA Immigration Attorney Near Me”
DACA has helped so many Dreamers. Indeed, we have a track record of assisting people with DACA applications, renewals, and more. But, it’s just one of the ways the immigration options are available. There are many, many others. If you reach out to us for a free constellation, we can talk to you about your specific situation. Then, we can find the best options to continue your immigration journey. For a free consultation with our attorneys, you can reach us through our site or at (855) 997-4525.

DACA Immigration Lawyer To Help Those Who “Are A Part Of Fabric Of Nation”

Are you a DACA recipient looking for help with your immigration? Or, alternatively, is someone you love a “Dreamer” and you want them to have the best representation possible? You can find an experienced DACA immigration lawyer here at the Rijal Law Firm. Our lawyers have a proven track record of fighting for our client’s immigration so that they’re able to continue to live their lives how they want. We can help in multiple ways.

DACA Immigration Lawyer Can Help As DACA Changes
Recently, the Biden administration “finalized a rule to transform the (DACA) immigration policy… into a federal regulation, a move aimed at protecting the program from legal challenges that imperil its existence.” The truth is that, as that CBS News article goes on to say, “even with the regulation, however, DACA will remain in legal jeopardy.” These laws can and have changed over the last so many years. No matter what, the Rijal Law Firm will fight to help you and yours to continue your immigration journey.

Help With Filing
There are many criteria that you have to meet to be eligible for DACA. As DACA is an acronym for “Deferred Action for Childhood Arrivals,” you have to be able to show that you entered America before your 16th birthday. Speaking of “proof,” you need to have proof of your identity as well as your immigration status and your status as a student. You will also need to have filled out Form I-821D, “Consideration of Deferred Action for Childhood Arrivals.” Those are just some of the forms of documentation you may be asked for. We can help you to put it all together so that you have the best chance.

Renewing DACA
It is possible to renew DACA, provided that you meet certain deadlines. For example, you can’t have been convicted of a felony or “significant” misdemeanor. Additionally, after you submitted a recently approved DACA request, you need to have resided continuously in the United States. These renewals tend to be processed in around four months. It’s also one more way that our firm can help. We’ve assisted so many in not just requesting DACA renewal but also helping our clients make this dream come true.

More Than DACA
DACA has been able to help so many to lead the lives that they want here in America. That said, it’s just one of the ways that we have helped folks to immigrate here. There are so many other methods. It might be that DACA isn’t a great fit for you but some other process would. When you reach out to us, we can talk to you, learn about your situation, and make the best recommendation. For a free consultation with our experts, you can message us through our site or call (855) 997-4525.

More Than A “Green Card Through Spouse” – A Family-Based Green Card

Have you been looking for the best way to immigrate to the United States? If you are married to a citizen of the United States, then that method may very well be to apply for a green card through spouse, through your marriage. However, it’s important to note that someone doesn’t’ exactly have to be your spouse to qualify for a family-based green card. We’re always glad to talk to people about how we can help their immigration journey.

Steps For Getting A Green Card Through A Family Member
To become an LPR (“Lawful Permanent Resident”) of the United States based on a familial relationship with a citizen, there is a process to follow. The very first step is to file an immigration visa petition (Form I-130) and get that approved. This has to be filed by a US citizen or a relative who’s an LPR. Next, the Department of State has to see if there’s an immigrant visa number available. If the person applying is already in America, then they can apply for adjustment of their status after a visa number becomes available. Should they be outside the country, then they can complete the processing with the Department of State’s National Visa Center. We understand this can be complicated but we can help throughout the process.

What To Know About Getting A Green Card Through Spouse
It’s impossible to overstate exactly how much the USCIS dislikes the idea of a “sham” marriage. It’s something that they are always on the lookout for people who are perhaps not in love, or only getting married so that one member or another could receive immigration benefits. The USCIS watches for this so closely that even a small mistake, a bit of missing evidence, can be enough for your application to be denied. Worse, this can cause you to lose your priority date and thus have to go back in line. We can work to keep that from happening.

The Best Option For You And Your Family
The Family Based Green Card very well could be the best way for you and yours to immigrate to the United States. However, it’s far from the only way. We’ve helped many to continue along this path but there are many other paths available. Here at the Rijal Law Firm, we offer free consultations. With these consultations, we’ll sit down with you and hear your story. Then, we’ll suggest how we may be able to help. To take the next step, you can reach us at (855) 997-4525.

Whether you need an F1 visa reinstatement lawyer or one to file your initial petition, we can assist in a variety of ways. Below are some factors to keep in mind.

File On Time
In many cases, the visa process can take a long period of time. As such, some students may feel that they can procrastinate or delay on their end. However, that’s not the case. Not meeting them can put your entire reinstatement in jeopardy. At the Rijal Law Firm, we can work to make sure that you meet every deadline no matter what.

Be Ready

The EB-1B can be a very viable path, so long as you have at least three years of experience and as well as a clearly-defined purpose in your visa application. As with all other forms of immigration, we can help you to make the best decision for your needs.

Other Options Available
That said, if you have a JD, Ph.D., law degree, Master’s, or a similar equivalent (typically a bachelor’s degree plus five years of progressive work experience in the right field) then you may qualify for an EB2 Advanced Degree Visa. This, however, requires the U.S. employer that’s offering you the job to seek labor certification. Essentially, that’s to get the Department of Labor to confirm that the company offering you the job did their best to find a qualified American worker but was unable to do so, hence, the necessity of reaching out to you.

More Than An EB-1 Immigration Lawyer
The EB-1A, the EB-1B, and the EB2 are just a few of the ways that you can immigrate to the United States. One of those very well might be right for you. However, it could also be that you could best benefit from some other form of immigration. We’re always glad to sit down with people to discuss how we could help their immigration. Even After Recent Changes, Help With Approval After NOID Is Essential

Did you recently receive a NOID and aren’t sure what to do next? Are you looking for the simplest, best way to receive approval after NOID? We may be able to help. We understand how frustrating or even scary it can be to receive a NOID, but it doesn’t mean that you’ve been denied. In fact, it means that you still have a chance. It means that to make a correct assessment, they’re going to need more information. We can help in a variety of ways.

Yes, You May Have More Time, But…
If you’ve received a NOID, the best course of action is to reach out to an experienced attorney that can help. In the majority of cases, the USCIS will give you 30 days to respond to the NOID (in some cases, due to some recent rule changes, you may have 45 days). Either way, that isn’t much time. By reaching out to an experienced attorney, you give yourself the best chance to successfully give the USCIS.

What Your Response Should Contain And Why
Essentially, it should address any and all of the issues that have been mentioned in your NOID. While the documentation can be difficult to parse, for the most part, the USCIS will tell you what it is that they want in the NOID so that they can make a determination. We know how to provide what they’re asking for as we have a proven track record of helping folks who are in the same position you are right now to be able to continue their immigration journey. Now, we can put that experience to work for your case.

What To Do If You’re Rejected
Even those with a strong case may still have their petition denied. Should that occur, it’s important to remember that you still have options. You are not out of luck by any means. You could, for example, re-file the petition. That could be the best option if you believed that your petition was denied due to errors that could be fixed. Alternatively, you could file a legal motion to reopen your case. Indeed, we’ve done that for clients when new evidence comes to light that bolsters their case. Another option: you could file for a different visa.

More Than Just Help With Approval After NOID
No matter where you are in the process, we may be able to help. If you’ve just received a NOID, we can put together the best possible case. Or, if you’ve already had your petition denied, we could help you to choose the best option moving forward. A NOID doesn’t have to be a setback. Indeed, with the right team by your side, you very well could get to where you want to go. For a free consultation, you can reach us through our site or call (855) 997-4525.

EB1 Visa Lawyer For Outstanding Researchers And Professors

Are you a professor who’s great at research and looking to come to the United States? Do you want to work with a visa lawyer you can trust? The EB1 visa, whether it’s the EB1A or the EB1B, is highly sought after for many reasons. An EB1 visa lawyer from our firm can help you to find the right visa for your specific needs. For many, the EB-1B is the best immigration solution.

EB-1B Benefits
For starters, if you have a family, your spouse and children will be eligible for green cards as well as work authorization, too. When you have an EB-1B visa, you don’t have to worry about certain concerns, such as having to get a US employer to seek labor certification from the Department of Labor. As an immigration visa classification, you’ll be able to qualify for an adjustment of status. Really, one of the main reasons that people opt for this EB1 visa is that, due to its standards, it tends to be more obtainable for folks like engineers, scientists, professors, and so forth.

How To Qualify
You need to be able to demonstrate that you have real achievements, that you have national or even international acclaim in your field. There are multiple forms of evidence of this required. We very well may be able to help you to put together a case utilizing those. Plus, you’re going to have to demonstrate that you are a great researcher/professor as well. That means that you need to have received some major awards for outstanding achievements and/or authored scholarly books/articles, and others. We can work with you to put together the best documentation for your case.

The Right Immigration Choice
We’re often asked what the difference between this and the EB-1A is. Obviously, the level of qualification is a big part of it, but one of the more overlooked differences is that with the EB-1B, you need to have at least three years of experience. No matter how good you are, you need to have a few years in. On top of that, this visa application essentially requires a clearly-defined purpose. As with the other facets of this visa, we can work with you to figure out the best course moving forward.

An EB1 Visa Lawyer For A Streamlined Process
The EB1 visa very well could be the right choice for your immigration needs. But, it’s far from all that we can help with. Indeed, when you reach out to us, we can help you to determine which category is most appropriate for your circumstances. Drawing upon our experience, we can help you to avoid the delay that is far too common with immigration so that you can continue on your journey. When It’s Time To Call A Fiance Visa Lawyer

Are you in love and looking to immigrate to the United States to be with your soon-to-be spouse? Or, alternatively, are you an American citizen who wants your beloved to immigrate? Then it very well may be time to contact a Fiance visa lawyer. Here at the Rijal Law Firm, we’ve helped so many happy couples to unite here in the United States. There are some things to keep in mind if you’re considering going this route.

You Must Be “Bona Fide”
In this context, “bona fide” doesn’t necessarily have “legal” standing. But, for you to truly qualify for this visa, everything must be legitimate. That means you and your fiance really do intend to establish a life together. Neither of you is doing this just to get some benefits from immigration or anything of that nature. Instead, you really do want to be together in the US. If that’s the case, then we may very well be able to help.

The Requirements
As the benefits of this can be great, the requirements for it can be stringent. For example, one of you must be a US citizen and you must marry within 90 days (roughly three months) of the fiance(e)’s admission to the United States. If you have any previous marriage, that has to have been terminated and you have to be legally able to marry. Plus, (and this one is key) you two must have met each other in person at least once in the last two years. There are exceptions to the last, but for the most part, those are the most commonly-met eligibility requirements.

How A Fiance Visa Lawyer Can Help
Namely through our experience. We know just how complex this particular visa process can be. So, when you reach out to us, we can get right to work on presenting the strongest possible petition for your visa. Always making sure that it’s backed by relevant supporting documentation, we can be by your side through the entire process. We can’t tell you how rewarding it is to see two people who love each other be able to be together how they want in the country of their choice. Now, we can put that experience to work for your case.

Many Ways To Continue An Immigration Journey
Yes, we’ve helped many to get a fiance visa over the years. However, it’s far from the only kind of visa or method of immigration that we can assist with. Everyone’s immigration situation and story are different. Our professionals can help you to write your own. We always encourage potential clients to reach out to us as early in the process as possible so that we have the best chance of setting you on the right path.
